1.    APPLICATION AND INTERPRETATION

1.1.  These terms and conditions set out the full and complete agreement (the “Agreement”) between the Customer and The Trustee for S D Pary Family Trust ABN 19 597 603 725 trading as Pura Cleaning (“Pura”, “us”, “we” and “our”) for the provision of services.

1.2.  By placing an order with us via telephone, fax, e-mail or website, and/or paying a deposit, the Customer agrees to the terms of this Agreement.

1.3.  These terms and conditions of this Agreement are subject to change without notice, from time to time in our sole discretion. We will notify the Customer of amendments to these terms and conditions by posting them to this website.

2.    Definitions

In this Agreement

2.1.  The “Customer” and “you” means any natural or incorporated party who:

2.1.1.       is named in the booking request and/or quote; and/or

2.1.2.       engages us to provide Services, either verbally or in writing; and/or

2.1.3.       is a beneficiary of the Services; and/or

2.1.4.       is an agent of the beneficiary of the Services.

2.2.  “Services” means the services and/or goods specified in the quote and booking request, and otherwise provided or performed by us for the Customer at the Customer’s verbal or written request.

2.3.  “Service Date” means the calendar date upon which we perform the Services to our satisfaction

2.4.  The singular includes the plural and vice-versa.

2.5.  Prices referred to are exclusive of GST.

3.    Payments

3.1.  Prices are subject to change so please request a quote before booking. You must pay a 20% deposit to confirm the booking of your Service.

3.2.  Payment methods we accept are Visa or Mastercard, and/or bank transfer. Direct debt via your nominated credit card can be setup via our secure payment system for recurring services.

3.3.  Payment for all Services must be made immediately upon completion of the Services, and no later thereof.

 3.3.1 Failure to pay within 5 days from the due date will result in a penalty interest charge of 20% of the total outstanding amount calculated annually and added to the outstanding amount.

3.4.  A travel surcharge may apply to bookings outside of the 30km radius from postcode 3073 (Reservoir).

3.5.  An idle fee of $10 per 15 minutes may apply for waiting periods 15 minutes over the confirmed booking time. Certain dates may be subject to an additional surcharge.

3.6. For clients holding a business account and have received an invoice for our services:

      3.6.1  Strict 14-day payment terms apply from the date of the invoice.

      3.6.2  Failure to pay on or before the due date will result in a penalty interest charge of 20% of the total outstanding amount calculated annually and added to the outstanding amount.

       3.6.3 An administrative fee of $90 will be charged for outstanding invoices over 30+ days.

             3.6.4 Failing to pay after a 60-day period will result in legal action and any costs associated will be charged to you.

       3.6.5 We reserve the right to suspend any/all services until outstanding amounts have been reconciled.

4.    Cancellations and rescheduling

4.1.  All cancellations/rescheduling must be made 24 hours prior to the confirmed cleaning service scheduled booking date. A cancellation fee of $40 or 20% of the quote, whichever is greater, may be charged to you in the event a booking is cancelled/rescheduled within a 24-hour period. Late cancellations cause a significate disruption to both our business and cleaners so please make sure you are confident in your booking date.

4.2.  We reserve the right to cancel/refuse services to clients that disrupt both our business and our cleaners.

4.3.  We cannot be held responsible for unforeseen delays.

     4.4. For recurring services that have entered into a contract agreement either party may terminate the agreement by giving 30 days written notice:

4.4.1.Once the initial contract term has been served;

4.4.2.Immediately if any condition outlined in 16.1 of this document has been met;

4.4.3.Failure to make payment 60 days after the invoice date.

5.    Rates and charges

5.1.  Pricing is based on hours per cleaner, chemicals, and equipment needed to complete set tasks at your residential or commercial property, with a minimum charge of $120 exclusive of GST. After correctly qualifying your requirements, we will either match you with one of our suite of services with a set price or provide you with a per hour quote based on tasks provided by you.

5.2.  Majority of cleaning can be completed within the quoted allocated time frames. On occasion locations will need extra attention and thus we reserve the right to charge an additional per hour fee to complete the desired service.

5.3.  If we find that information given by you on the state or size of the home or office does not match with information provided, or has been misrepresented in anyway, we have the right to either:

5.3.1.       Cancel the service and charge you 20% of the quote; or

5.3.2.       Requote

5.4.  We reserve the right to adjust or change our rates and charges at any time without notice.

5.5.  Quotes are subject to an initial inspection and expire within 7 days unless otherwise advised.

5.6.  Quotes are based on allocated time frames. Cleaners can finish jobs within these time frames with original quotes remaining. Additional charges may apply for any time taken over the original allocation.

5.7.  All jobs are governed by our terms and conditions and by accepting any part of a quote or once work commences you automatically adhere to these terms.

6.    Satisfaction guarantee

6.1.  Your satisfaction is our number one priority and thus we offer a 100% satisfaction guarantee on all our services.

6.2.  In the event of an alleged concern or defect in the provision of our Services (the “Alleged Defects”), you must notify us in writing within 2 calendar days of the Service Date and provide us with complete details and photographs of the Alleged Defects.

6.3.  Subject to your compliance with term 6.2 above, and our sole assessment of the Alleged Defects, we may either refuse or agree to rectify the Alleged Defects.

7.    Booking date and times

7.1.  You must allow 30 minutes after your set booking time for our cleaners to arrive. This is to allow for unpredictability of traffic delays, parking, and any other unforeseen events that may occur from time to time.

8.    Accessing your property

8.1.  You must provide our cleaners with

8.1.1.       at least one parking spot as close as possible to the entrance to complete and give the best possible level of service. If a parking spot close to the entrance or front door is not available, we will seek payment for parking and/or the cost will be added to your quote;

8.1.2.    Running hot water;

8.1.3.    Electricity; and

8.1.4.    Council provided rubbish bins.

8.2.  You must also take full responsibility for:

8.2.1.    Any pets – this means securing animals away from the property while the service is being completed

8.2.2.    Infants or children under the age of 16 years old

8.2.3.    House guests

8.3.  In the event of any failure to comply with terms 8.1 and/or 8.2, you may incur an additional charge of $40.

9.    Biohazards, Pets, Hoarding, High Reach Areas

9.1.  Below is a list of non-negotiables that we will avoid for the safety and health of our cleaner’s, and may impact our ability to carry out the Services.

9.1.1.    Bacteria, mould and fungi

9.1.2.    Blood and body fluids including vomit, mucous, urine and faeces

9.1.3.    Medical syringes

9.1.4.    Sewage

9.1.5.    Stinging insects and harmful plants

9.1.6.    Animal and bird faeces

9.1.7.    Dangerous pets

9.1.8.    Hoarding conditions

9.1.9.    Heights over a 2-step ladder

9.2.  Our cleaners have the right to refuse service for any of the above situations occur or an additional fee may be charged. We cannot guarantee your 100% satisfaction if any of the above are found at the property.

10. Keys

10.1.  In the event that you are unable to be at the property to complete the service you must provide us with either of the following acceptable methods of entry:

10.1.1. Entry Instructions

10.1.2. Alarm codes

10.1.3. Lock box with the appropriate access code

10.1.4. Set of keys (to take with us and store securely on site) 

10.2.    If we are providing you with a recurring cleaning service, residentially or commercially, we are happy to be given a set of keys that will be securely stored in a lock box, un-addressed, on site at our office. If you decide to cancel a recurring service, or request your keys back in writing, you are welcome to pick up your keys from our site on Settlement Road, Bundoora, Victoria. Upon arrival we will need photo id with your current address to confirm your identity.

10.3.    Our cleaners have the right to refuse service if they feel unsafe with entry instructions provided and a $40 fee will be charge for loss of time

11. Safety

11.1.                Safety is our primary concern for both you the client and our cleaners.

11.2.                We do not allow our cleaners to work on services who have not completed both a police check, and a medical check.

11.3.                Our cleaners take the up most care to ensure the least amount of contact with your home. They will be wearing both disposable gloves and a face mask when completing services.

11.4.                We do not allow our cleaners to move or lift heavy items

11.5.                Our cleaners cannot clean above what can be reached with a 2-step ladder

11.6.                For services that have an allocated time of 5+ hours appropriate, rest breaks must be provided in accordance with Australian law.

12. Breakages, Property Damage, Losses

12.1.                In the event of alleged loss or damage to your property by us in the course of carrying out the Services (“alleged Damage”), you must notify us of the Alleged Damage in writing within 2 calendar days of the Service Date, with complete details, cost estimates and supporting photographs of the Alleged Damage.

12.2.                Subject to your compliance with term 12.1 above, and our sole assessment of the Alleged Damage, we may either refuse or agree to rectify the Alleged Damage.

12.3.                We will not be held responsible for any loss or damage due to normal wear and tear, deterioration caused by age, damage caused by improper assembly, construction, or mounting of any kind to any item.

12.4.                It is your responsibility to inform us immediately if any items in your home require this type of attention.

13. Digital images

13.1.    You authorise us to photograph and/or motion film your property before and after then provision of Services, and to reuse, reproduce, publish and/or distribute said photographs and/or motion film for marketing purposes.

13.2.    You agree that all rights, title and interest in the photographs and/or motion film referred to herein shall remain our sole and unencumbered property (including present and future copyright).

14. Force Majeure

14.1.     We will not be liable for failing to perform under this Agreement by the occurrence of any event beyond our reasonable control, including a labour disturbance, internet outage or interruption of service, communication outage failure by a service provided to us to perform, fire, threatened or actual act of terrorism, natural disaster, or war.

15. Release and indemnity

15.1.    You hereby release and indemnify us from and against any and all claims, losses, liabilities, settlements, expenses, and damages, including legal fees and costs (all referred to collectively as “Claims”), which we may suffer or to which we may be subjected for any reason, even if attributable to negligence on our part or any other entity, arising out of or related to any act, omission, or occurrence in connection with the creation, production, or use of any image or the provision of any goods and/or services relating to this Agreement or its subject matter. This provision shall apply to Claims of every sort and nature, whether based on tort, strict liability, personal injury, property damage, contract, defamation, privacy rights, publicity rights, copyrights, or otherwise. You assume all risks, and its obligations under this provision shall survive the performance, termination, or cancellation of this Agreement.

16. Right to refuse services

16.1.    We reserve the right to refuse and/or cancel services for any reason. These reasons may include but not limited to:

16.1.1.    Staff, contractors, cleaners feeling threatened, unsafe, or uncomfortable for any reason

16.1.2.    Cleaners not able to complete services within the allocated time

16.1.3.    Condition or state of property was incorrectly described by you the client

             16.1.4.  Service requested is not as described by client
